Fossick Terms of Use
Effective date: 2 November 2026. The current version is always at fossick.app/terms.
1. About these Terms
1.1 These Terms of Use are an agreement between you and Mason Houlahan, a sole trader trading as Fossick (ABN 65 597 343 830) ("Fossick", "we", "us", "our"). They apply to your use of the Fossick iOS app and fossick.app (together, "Fossick").
1.2 By creating an account or using Fossick, you agree to these Terms. Our Privacy Policy (fossick.app/privacy) explains how we handle your personal information.
1.3 Fossick is supplied through Apple's App Store, so Apple's standard Licensed Application End User License Agreement (the "Apple EULA") also applies. These Terms add to the Apple EULA; they don't replace it. If these Terms and the Apple EULA conflict about your licence to use the app, the Apple EULA applies.
1.4 Nothing in these Terms limits your rights under the Australian Consumer Law. See section 7.
2. Who can use Fossick
2.1 You must be at least 18 years old to use Fossick.
2.2 If we reasonably believe someone under 18 is using Fossick, we may suspend or delete their account. We'll delete their personal information as described in our Privacy Policy, and they can ask Apple for a refund.
3. Your account
3.1 Please give us accurate information. If you need to change the email address on your account, email us at support@fossick.app. We send sign-in codes to your email, so anyone with access to your email may be able to access your Fossick account. Keep your email account secure.
3.2 Your account is for you alone. Don't share it or let anyone else use it.
3.3 You're responsible for what happens in your account. If you think someone has accessed it without your permission, email us at support@fossick.app.
3.4 The name on your account appears on Find Cards you share. You can use a nickname.
4. Subscriptions and payment
4.1 You need a subscription. After onboarding, you need an active subscription or free trial to use Fossick's features.
4.2 Plans. Fossick is offered at A$6.99 per month or A$59.99 per year, including GST. The price shown in the app when you subscribe is the price you pay.
4.3 Free trial. New subscribers get a 7-day free trial. Apple decides who is eligible — for example, you may not get a trial if you've had one before. Unless you cancel at least 24 hours before your trial ends, it automatically becomes a paid subscription to the plan you chose, and you'll be charged when the trial ends.
4.4 Auto-renewal. Your subscription renews automatically for the same period at the then-current price unless you cancel at least 24 hours before the end of the current period. Apple charges your Apple ID payment method within the 24 hours before each new period starts.
4.5 Cancelling. You can cancel at any time in your App Store subscription settings. Deleting the app or your Fossick account does not cancel your subscription. After you cancel, you keep access until the end of the period you've paid for.
4.6 Payments and refunds. Apple processes all payments and refunds under its own terms. To request a refund, contact Apple (reportaproblem.apple.com). This doesn't limit your rights under the Australian Consumer Law — if you think Fossick hasn't met a consumer guarantee, contact us and we'll help, including by supporting your refund request with Apple.
4.7 Price changes. We may change our prices. Apple will tell you before a price increase applies to your subscription and, where Apple requires, ask for your consent. If you don't want to pay the new price, you can cancel before it applies.
4.8 If your subscription ends. You keep read-only access to your Collection, but you can't scan, save, share or delete items. You can still delete your whole account at any time (section 11.1).
5. Fair use
5.1 Your subscription includes up to 100 scans per day. The count resets at midnight Sydney time (AEST or AEDT).
5.2 We may limit or pause scanning on an account if we reasonably believe it's being used in an automated or abusive way, or in breach of section 10.
5.3 If we permanently reduce the daily limit, we'll give you at least 30 days' notice, and you can cancel before the change applies. This doesn't cover temporary pauses for maintenance, outages or misuse (sections 5.2 and 13.1).
6. Finds are estimates, not appraisals
6.1 How Finds work. Finds are generated by artificial intelligence from your photos. Estimated values reflect the AI's assessment of typical resale prices on marketplaces such as Depop, eBay and Vinted. Fossick doesn't look up live listings when it makes an estimate. A Find is designed to help you decide what's worth a closer look — not to give you a final answer.
6.2 Values. Every value is shown with the words "Estimate only — not an appraisal or authentication." Values are a range in Australian dollars and may be wrong. What an item actually sells for depends on things a photo can't show, including condition, size, demand, timing and where and how you sell it.
6.3 Authenticity. Authenticity notes are observations about features the AI noticed, such as labels, stitching or hardware. They are never a verdict that an item is genuine or counterfeit.
6.4 Provisional results. Results with a confidence level below 70% are marked provisional. Treat them with extra caution.
6.5 Rarity tiers. Staple, Keeper, Rare and Grail are Fossick's own guide to how notable an item is. They are not an industry standard.
6.6 What this means for you. Please don't rely on a Find alone when deciding whether to buy, sell, insure or authenticate an item, or when valuing it for insurance, tax, legal or similar purposes. For decisions that matter, get an independent appraisal or authentication from a qualified professional. You must not present a Find to anyone as an appraisal, authentication or certificate.
6.7 We work hard to make Finds useful, but we can't promise that any Find is accurate or complete. This section doesn't limit your rights under the Australian Consumer Law (section 7).
7. Your rights under the Australian Consumer Law
7.1 Our services come with guarantees that cannot be excluded under the Australian Consumer Law. For example, we must supply our services with due care and skill, and they must be reasonably fit for any purpose we've told you they're for.
7.2 If our services fail to meet a guarantee, you may be entitled to remedies. For a major failure, you can cancel and get a refund for the unused portion, or compensation for the drop in value. For other failures, we'll fix the problem within a reasonable time. You may also be entitled to compensation for other reasonably foreseeable loss.
7.3 Nothing in these Terms excludes, restricts or changes any guarantee, right or remedy you have under the Australian Consumer Law or any other law that can't be excluded. Any part of these Terms that might otherwise do so applies only as far as the law allows.
8. Your photos and content
8.1 You own your photos. You keep ownership of the photos you upload.
8.2 Our licence to process them. You give us a non-exclusive, worldwide, royalty-free licence to store, copy, resize, process, send and display your photos and Finds, only as needed to provide Fossick to you, keep it secure and comply with the law. This includes sending your photos to our service providers, including our AI provider overseas, as described in our Privacy Policy.
8.3 This licence ends when you delete the content or your account, except for copies in backups until they expire and Find Cards you've already shared.
8.4 We won't use your photos in our marketing, or to train AI models, without your permission.
8.5 Your rights to upload. You must only upload photos you have the right to use — normally, photos you've taken yourself.
8.6 Using your Finds. You may use your Finds and Find Cards for any lawful purpose, including in your own resale listings, subject to section 6.6. The Fossick name, logo and Find Card design remain ours (section 12).
9. Sharing Find Cards
9.1 A Find Card shows details of your Find (which may include your photo), the estimate disclaimer, the Fossick branding and "Found by {name}".
9.2 You decide whether and where to share a Find Card. Once it's shared, it's outside Fossick and we can't remove it.
9.3 Before you share, check that your photo doesn't show other people or personal information you don't want to share.
9.4 Brand names appear on Find Cards only to describe items. Fossick isn't affiliated with or endorsed by those brands. Don't edit a Find Card to suggest an item has been authenticated or that a brand endorses it.
10. Acceptable use
10.1 Fossick is designed for clothing, footwear, bags, jewellery, watches and wearable accessories. Results for other items may be unreliable.
10.2 You must not:
- use Fossick for anything unlawful, or in a way that infringes anyone else's rights;
- deliberately photograph other people, or upload photos of people without their permission;
- upload offensive, intimate or illegal material;
- present a Find as a professional appraisal, authentication or certificate, or use Fossick to help sell counterfeit goods or mislead buyers;
- use bots, scripts or other automated means to access Fossick, or try to get around the fair-use limit;
- share your account, or offer scanning through Fossick as a service to others;
- copy, reverse engineer or extract Fossick's software, prompts or outputs to build a competing product, except as the law allows; or
- interfere with Fossick's security or operation, or try to access other users' data.
11. Suspension and termination
11.1 You can leave at any time. Delete your account in the app, and cancel your subscription in your App Store settings.
11.2 We may suspend or close your account if you seriously or repeatedly breach these Terms, if the law requires it, or if it's reasonably necessary to protect Fossick, other people or our service providers. Where it's reasonable to do so, we'll tell you first and give you a chance to fix the problem.
11.3 If we close your account for another reason, or stop offering Fossick, we'll give you at least 30 days' notice where we can, and refund the unused part of any prepaid subscription. Because Apple processes payments, we may do this by asking Apple to refund you or by paying you directly.
11.4 When your account is closed, your right to use Fossick ends, and we'll delete your information as described in our Privacy Policy.
12. Fossick's intellectual property
12.1 Fossick — including the app, its software, design and content, the Fossick name and logo, the rarity tier system and the Find Card design — belongs to us or our licensors. Your right to use the app comes from the Apple EULA and these Terms.
12.2 If you send us feedback or ideas, we may use them freely without paying you.
13. Availability and changes to Fossick
13.1 We aim to keep Fossick running smoothly, but it may sometimes be unavailable — for example, for maintenance or when a service provider has an outage.
13.2 We may change, add or remove features over time. If a change significantly reduces what your paid subscription includes, we'll give you reasonable notice, and you can cancel before it applies.
14. Our liability
14.1 Nothing in this section limits your rights under the Australian Consumer Law (section 7).
14.2 Where the Australian Consumer Law allows us to limit our liability for failing to meet a consumer guarantee, our liability is limited to supplying the services again or paying the cost of having them supplied again.
14.3 As far as the law allows, we're not liable for loss that we didn't cause, or that results from relying on a Find contrary to section 6.6, from events beyond our reasonable control, or from what happens to a Find Card after you share it.
14.4 As far as the law allows, our total liability to you in connection with Fossick is limited to the amount you paid for Fossick in the 12 months before the claim arose. This doesn't apply to liability that can't be limited by law.
15. Changes to these Terms
15.1 We may update these Terms — for example, to reflect changes in the law, our features or our service providers.
15.2 We'll post updated Terms at fossick.app/terms. If a change materially affects you, we'll tell you in the app or by email at least 30 days before it takes effect.
15.3 If you don't agree to a change, you can cancel your subscription and delete your account before it takes effect. If the change is materially adverse and you have a prepaid annual subscription, we'll refund the unused part of it in the same way as section 11.3. If you keep using Fossick after the change takes effect, the updated Terms apply.
16. Governing law and disputes
16.1 These Terms are governed by the laws of Western Australia. You and we submit to the non-exclusive jurisdiction of its courts.
16.2 This doesn't stop you relying on consumer protection laws, or using courts and tribunals, in the State or Territory where you live.
16.3 If you have a problem with Fossick, please contact us first. We'll try to resolve it within 30 days. You can also contact your local consumer affairs or fair trading agency.
17. General
17.1 These Terms, our Privacy Policy and the Apple EULA are the whole agreement between you and us about Fossick.
17.2 If any part of these Terms is invalid or unenforceable, the rest still applies.
17.3 If we don't enforce a right straight away, we haven't given it up.
17.4 We may transfer these Terms to a business that takes over Fossick (for example, a company set up to run it), as long as your rights under these Terms aren't reduced. We'll tell you if this happens. You can't transfer your account or these Terms.
